Welcome to our website.  If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together govern Fleur Social’s relationship with you in relation to your use of this website.

By using this website, you signify your acceptance of these terms and conditions of use.  For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to Fleur Social and “You” and “Your” refers to you, the client, visitor, website user or any person using our website.


AMENDMENT OF TERMS

We reserve the right to change, modify, add or remove portions of these terms at any time.  Please check these terms regularly prior to using our website to ensure you are aware of any changes.  We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and Fleur Social’s rights and obligations to each other.


LIMITATION OF LIABILITY

It is an essential pre-condition to you using our website that you agree and accept that Fleur Social is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website.  Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable.

It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements.  You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.


COMPETITION AND CONSUMER ACT

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010, Fleur Social’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

You must be over 18 years of age to use this website and to purchase any goods or services.


DELIVERY OF PHYSICAL GOODS


SAME DAY DELIVERY

Fleur Social offers same day delivery in the Barossa and Gawler area from Monday to Saturday (excluding public holidays) if orders are placed before 11am Australian Central Standard Time.  If orders are placed after this time or for a day we are closed, we will do our best to deliver as requested but are unable to guarantee it. If unable to honour the delivery request the delivery will be moved to the following business day.

PRODUCT SUBSTITUTION POLICY

Product images pictured on this site are Mega Size and to be used as a guide only.  Your bunch will be bespoke and inspired by the descriptive words, each bunch as different as you are.  As blooms are seasonal, they will change, Fleur Social reserves the right to make fair and reasonable substitutions according to the practical availability of specific flower types and colours.

DELIVERY FEES

Delivery fees are priced according to distance from Fleur Social, please select your town from the shipping options at checkout. If your town does not appear as a shipping option please call the shop on (08)8562 1612 to enquire about shipping rates.

DELIVERY POLICY

Fleur Social and our couriers will do our absolute best to deliver your order.  If advised by you that we are able to leave the delivery unattended in the event that no one is home, then we will do so by leaving the flowers in the shade and in water (up to 30 degrees).  If you have requested that we not leave the order unattended and no one is home to receive them, you may be liable for a re-delivery fee or to arrange for shop pick up. Additionally, if the temperature is above 30 degrees and no one is home to receive the order we will not leave it unattended and you may be liable for re-delivery fee or to arrange for shop pick up.  Prior to leaving the delivery address we will do our best to contact you for further instructions. If Fleur Social have been given permission to leave your order unattended, we cannot be held liable for what happens to flowers after delivery has occurred. If you have any issues with the order please call us immediately at the shop on (08)8562 1612.

By ordering with Fleur Social we can only assume you have read our terms and conditions and accept/acknowledge the information within them.

CANCELLATION

Should you need to cancel your order and our courier has not left yet then we may be able to cancel your order, if the order has been delivered then we will not be able to cancel your order.  Please call the shop immediately if you do need to cancel and we will do our best to accommodate you.


RETURNS AND REFUNDS

Fleur Social is committed to provided the best quality product and experience possible and want to ensure you are happy with your product and service.   If you believe that you haven’t received the product or service that you expected then please call Fleur Social on (08)8562 1612 to discuss a solution to the problem.  If you would like a refund then you will need to provide photographic proof of the issue within 24 hours of receiving the product to qualify. Fleur Social reserves the right to provide a replacement of equal value or re-send the flowers in lieu of a monetary refund.

At Fleur Social we are committed to protecting your privacy.  We use the information we collect about you to maximise the services that we provide to you. Fleur Social respects the privacy and confidentiality of the information provided by you and adheres to the national privacy principles established pursuant to the Privacy Act 1988 (Commonwealth).
